Welcome to Mahjong Stars. These Terms and Conditions (“Terms”) govern your access to and use of the website, online game services, community forums, and any related services (collectively, the “Service”) provided by Wasabi Games DMCC.

Please read these Terms carefully. By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

The Service is operated by Wasabi Games DMCC (“we”, “us”, “our”), a company registered in the United Arab Emirates under registration number DMCC-919416, with its registered address at Jumeirah Lake Towers, Dubai, UAE.

2. Agreement to Terms

By using our Service, you confirm that you accept these Terms and that you agree to comply with them. These Terms apply to all visitors, users, and others who access the Service.

You represent and warrant that you are at least 18 years of age, or the age of legal majority in your country of residence, and are legally capable of entering into a binding agreement. The Service is not intended for individuals under this age.

3. The Service

Our Service primarily consists of the online game "Mahjong Stars", associated community features such as forums, and may in the future include Web3 components like digital tokens and Non-Fungible Tokens (NFTs).

The Service is provided on an “as is” and “as available” basis. We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

Currently, our Service is free to use. We may introduce paid services, virtual items, or subscriptions in the future. Any such changes will be subject to additional terms, which will be made available to you at that time.

4. User-Generated Content

Our Service may allow you to post, link, store, share, and otherwise make available certain information, text, graphics, or other material (“User-Generated Content”), for example, in our community forums.

You are solely responsible for the User-Generated Content that you post on or through the Service. By posting content, you represent and warrant that:

  • The content is yours (you own it) or you have the right to use it and grant us the rights and licence as provided in these Terms.
  • The posting of your content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

By submitting User-Generated Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media in connection with the operation and promotion of the Service.

We reserve the right, but not the obligation, to monitor, edit, or remove any User-Generated Content that we determine, in our sole discretion, to be unlawful, offensive, threatening, defamatory, or otherwise objectionable or that violates any party’s intellectual property or these Terms.

5. Intellectual Property Rights

The Service and all its original content (excluding User-Generated Content), features, and functionality are and will remain the exclusive property of Wasabi Games DMCC and its licensors. This includes, but is not limited to, all software, text, images, graphics, logos, and the Mahjong Stars brand. Our intellectual property is protected by copyright, trademark, and other laws of both the United Arab Emirates and foreign countries.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use, strictly in accordance with these Terms.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.

6. User Obligations and Prohibited Conduct

As a condition of your use of the Service, you agree not to:

  • Use the Service for any unlawful purpose or in any way that breaches any applicable local, national, or international law or regulation.
  • Infringe upon or violate our intellectual property rights or the intellectual property rights of others.
  • Harass, abuse, insult, harm, defame, slander, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
  • Submit false or misleading information.
  • Upload or transmit viruses, worms, or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service.
  • Attempt to gain unauthorised access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.

A breach or violation of any of these Terms will result in an immediate termination of your access to our Services.

7. Disclaimer of Warranties; Limitation of Liability

We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free. The Service is provided without any guarantees, conditions, or warranties as to its accuracy, completeness, or reliability.

To the fullest extent permitted by law, in no case shall Wasabi Games DMCC, our directors, officers, employees, affiliates, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, loss of data, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the Service or your inability to use the Service.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.

8. Data Transmission

You understand that your User-Generated Content may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to the technical requirements of connecting networks or devices. Any personal data you provide is handled in accordance with our Privacy Policy.

9. Termination

These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by ceasing to use our Service.

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

10. Changes to These Terms

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. We will notify you of any material changes via a site update, banner notification, or, where appropriate, by email.

It is your responsibility to check this page periodically for changes. Your continued use of or access to the Service following the posting of any changes constitutes acceptance of those changes.

11. Governing Law and Jurisdiction

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Arab Emirates, as applied in the Emirate of Dubai.

However, if you are a consumer resident in the European Union, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

12. General Provisions

Severability: In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

Entire Agreement: These Terms and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written.
